WACA Membership Terms & Conditions

By registering as a Western Australian Cricket Association (WACA) Member (including by renewing an existing membership), you agree to be bound to these terms and conditions and the terms and conditions of the WACA Constitution and By-laws.

The WACA has converted its legal status from an Incorporated Association to a Company Limited by Guarantee (“CLG”). By joining or renewing your membership of the WACA, you are consenting to become a member of the CLG. Members of the WACA as a CLG will have a maximum liability of $1.00 on a winding-up of the WACA.

1. Definitions

“Cricket Australia” means Cricket Australia (ABN 53 006 089 130) of 60 Jolimont Street, Jolimont, VIC 3002.

“Guest Card” means a pass referred to in By-Law 7.3 (a).

“Member” means a person who has joined and fully paid for a membership with the WACA for the duration of the membership in the applicable cricket season.

“Members Reserve” means the area which houses dedicated Member seating at both Optus Stadium and the WACA Ground.

“Optus Stadium” means Optus Stadium of PO Box 113, Burswood, WA 6100.

“Visitor Pass” means a pass referred to in By-Law 7.3 (b).

“WACA” means the Western Australian Cricket Association (ABN 44 026 744 769) of PO Box 6045, EAST PERTH, WA 6892.

“WACA  Account Manager” means the sign in page to access your membership account online located at am.ticketmaster.com/waca/.

“State Associations” means a state association membership of Cricket Australia.

“You” or “your” means the individual person who is designated as the Member in the completed WACA Account Manager page that is completed online via wacricketmembership.com.au or through information provided to the WACA via phone, mail, email or in person.

2. Membership

2.1 Membership Registration

The WACA has the right to accept or reject any registration for membership of the WACA at its sole and discretion. It is entitled to reject registration even after payment for membership has been processed and confirmation of membership registration has been provided. In the event rejection occurs after payment is received the WACA may refund the relevant membership fee to the applicant.

The WACA will not process any registration that has not completed all mandatory fields where indicated on the Membership Account Manager page or relevant application forms.

When you register:

  • Online for a WACA Membership via com.au, your registration will be successful when payment has been taken and a confirmation message appears on your screen or;
  • Over the phone or in person for a WACA Membership, your registration will be successful when payment has been taken and you receive a confirmation email to the registered email address.

2.2 Term of Membership

Subject to the terms and conditions of membership as outlined in this document, the WACA Constitution and By-Laws and additionally as further advised by the WACA from time to time, your WACA Membership will entitle you to the benefits of your selected membership solely for the season it has been purchased for.

The membership is purchased for the 2021-22 cricket season only. The price of a 2021-22 WACA Ground Membership, Add-On and Premium products will not be reduced on the basis that an applicant wishes to purchase those membership elements at any point once the season is underway.

2.3 Membership, Add-On Products and Premium Products

Following products can be added to a WACA Ground Membership:

2.4 Age Qualifications for Admission to Classes of Membership

Following age qualifications for admission to certain classes of membership apply:

  • Junior Members: Children aged 4-17 years as of 30 September 2021 qualify as Junior Members.
  • Young Adult Members: Adults aged 18-22 years as of 30 September 2021 qualify as Young Adult Members.
  • Age Concession Members: Adults residing within a 100km radius of the WACA Ground aged 65 years and over as of 31 September 2020 qualify for a concession rate.

2.5 Companion Guest Cards

Complimentary Companion Guest Cards are available to Members who hold a valid companion card. In order to receive a complimentary Companion Guest Card:

  • The companion card holder must have purchased a current WACA Ground Membership and Match Access Card; and
  • Must have a current, valid companion card.

To obtain the complimentary Companion Guest Card, you must apply directly to the WACA and provide a copy of your, valid current companion card.

The WACA will:

  • Process a complimentary Companion Guest Card; and
  • Issue the complimentary Companion Guest Card in the name of the Member (it cannot be processed under another individual’s name).

Complimentary Companion Guest Cards are transferable, however, can only be used when the paying WACA Member is in attendance and are limited to one (1) per Member.

3. Visitor and Upgrade Passes

WACA Management and the Board reserve the right to limit the number of Visitor and Upgrade Passes available for each game and change these terms and conditions without notice.

Only current financial Members of the WACA with Match Access Cards can purchase Visitor and Upgrade Passes to Optus Stadium and they cannot be on sold under any circumstance.

Visitor and Upgrade Passes to Optus Stadium are not available to Members who have elected to purchase the WACA Ground Membership only without Match Access to international cricket and the BBL (Perth Scorchers Men).

Visitor and Upgrade Passes must be displayed to a WACA or Optus Stadium official upon request.

Visitor and Upgrade Passes are subject to availability and no guarantees can be given that there will be enough available to meet demand.

Members are reminded that they are responsible for ensuring that their visitors observe the etiquette required in the exclusive Members Reserve and respective other membership areas. The Member will be held responsible for all actions of their visitors as per the membership By-Laws.

No refunds will be issued on Visitor and Upgrade Passes, including those pre-purchased. Special refund conditions may apply for whole days of play that are lost due to inclement weather or COVID-19 restrictions.

Members who elect to purchase Upgrade Passes will have their regular Match Access, Guest or 1885 Club Cards invalidated for the match they purchased the Upgrade Pass for.

3.1 Print Your Own Visitor Passes

Visitor Passes will not be posted out. They are available electronically through Members’ online WACA Account Managers. Log into your online WACA Account Manager to print or forward passes for individual matches. If you lose your pass, you have the option of re-printing your pass through your online WACA Account Manager.

4. Public Transport

Match Access, Guest Cards, 1885 Club Cards, Champions Club Cards and Visitor Passes include public transport to and from Optus Stadium on match days. This applies to all Perth metropolitan bus and train services, as well as additional buses and trains that may operate on match days.

Match Access, Guest Cards, 1885 Club Cards, Champions Club Cards and Visitor Passes do not include public transport to and from the WACA Ground on match days.

5. Seat Ownership: Premium Reserved Seats

Venue seating remains the property of Optus Stadium and is made available to the WACA to offer a renewal arrangement to Members on a year by year basis for the duration of the cricket season only. Season seat holders do not hold any rights to access their season seat for any other events or matches apart from matches as specified by the WACA within the cricket season.

Same seat renewals are not guaranteed.

6. Conditions of Entry & Member Behaviour

Entry to all international, domestic and Perth Scorchers matches and continued attendance at those matches is governed by Cricket Australia’s Ticket and Entry Conditions (as amended by Cricket Australia from time to time, as published at www.cricket.com.au/tickets/terms-and-conditions) as well as terms and conditions of ticket purchase of the relevant ticket agency and any terms and conditions of entry of the relevant venue owner, manager or hirer which can be found here: https://optusstadium.com.au/legal/conditions-of-entry. When entering and attending a match, you agree to abide by the conditions outlined in all the policies, terms and conditions and policy statements and that you can be refused entry or removed from a venue due to failure to comply with any of these policies, terms and conditions and policy statements. You agree that the WACA can cancel your membership at any time if you fail to comply with any of these policies, terms and conditions and policy statements.

Offensive or aggressive behaviour is not tolerated at any matches and may result in the imposition of penalties including the cancellation of membership. This includes, but is not limited to, swearing, yelling, intimidation, aggressive, abusive or threatening behaviour towards players, staff, event staff, or other supporters and memberships, including, but not limited to, at matches, WACA events, over the phone, on any social media, by email or in person.

7. Membership Renewals

7.1 Renewal Notifications

Renewal notifications for memberships will be sent via email to the Member’s registered email address. It is the responsibility of the Member to follow up on renewal communications, which may not have been received, and ensure the WACA has correct contact details at all times.

7.2 Renewal Due by Date

The renewal due by date for Members to retain their memberships and premium reserved seats, if applicable, from the previous season will vary from season to season. Failure to renew memberships and premium reserved seats by the specified due date will lead to the Member forfeiting his or her right to retain the previous season’s membership and premium reserved seats. Members may be reminded via email to renew by a specific date to retain previous season’s memberships and premium reserved seats, however, it is the responsibility of Members to make their own enquiries about renewals. Members will not receive personal renewal reminders or follow ups via mail, email or phone if memberships and seats have not been renewed by the due date.

7.3 Late Renewals & Reserved Seats

The acceptance of any late renewal will be determined solely by the WACA in its discretion. In such cases where late renewals are offered, late fees may be applicable. Alternatively, if a late renewal is not accepted, Members will be required to re-apply for a membership and premium reserved seating as a new applicant.

The WACA reserves the right to change any Member’s allocated premium reserved seat where required by the relevant venue owners or hirers, Cricket Australia, or the WACA. Where practical, the WACA will try to accommodate any changes within the same seating bay as previously allocated. A late renewal of a premium reserved seat will not allow a Member to renew his or her previous season’s seat.

8. Membership Payment

Except where stated otherwise, all membership prices are inclusive of GST. All prices displayed are in Australian Dollars (AUD).

8.1 Payment Plan (Upfront & Part Payments)

When you pay your membership fees you authorise the WACA to automatically renew your membership each season into the same Member class (or a reasonably comparable class) and to deduct the applicable membership fees from the credit card or debit card used to purchase your previous membership. You can opt out of automatically renewing your membership by calling the WACA Membership Office on 08 9265 7279 or emailing membership@waca.com.au and requesting to remove your payment plan.

If you participate in the upfront or part payment plans, the WACA will contact you at least ten (10) days prior to debit date with the option to opt out of the auto renew program. Payment will be one full payment or payment instalments debited as elected by the Member via the Member’s nominated credit/debit card recorded in their Member account.

8.2 Payment Terms

By paying for membership via auto renew, Members accept full responsibility for:

  • The accuracy and truth of the account details they have provided and responsibility for notifying the WACA should the expiry date change; and
  • Ensuring that there are sufficient clear funds available in the nominated account on the scheduled drawing date.

If a debit is returned or dishonoured by the Member’s financial institution an email will be sent requesting immediate payment. Any fees levied to the Member by the financial institution will be payable by the Member and the WACA accepts no liability for such fees. The WACA may suspend or cancel your membership if your instalment is dishonoured by your financial institution.

8.3 Membership Refunds & Cancellation Information

8.3.1 WACA Ground Membership

WACA Ground Memberships are non-refundable and once purchased the WACA is under no obligation to provide a cancellation, refund or credit, except where required by law or in accordance with the WACA’s Constitution or By-Laws. In particular, no refunds or credit will be issued for any cricket schedule fixture changes to competitions included in your WACA Ground Membership as your membership fees support cricket throughout Western Australia.

8.3.2 COVID-19

8.3.2.1 Government Directed Closures

If, due to COVID-19 government restrictions, cricket fixtures for international matches and Perth Scorchers Men home games result in reduced matches for our Members at Optus Stadium, a pro rata credit will be calculated accordingly and applied to the following:

  • Match Access Card
  • Guest Card
  • 1885 Club Card
  • Champions Club Card
  • Premium Reserved Seats

Members are able to donate the credit amount to the WA Cricket Foundation.

8.3.2.2 Health and Safety Concerns

The WACA does not need to provide a credit if a Member:

  • Is well and does not wish to attend an event due to fears of exposure to COVID-19; or
  • Is unwell and does not attend an event (other than due to COVID-19 illness or symptoms); or
  • Is from a group at a higher risk of COVID-19; or
  • Is denied entry into the event for reasons which were disclosed to the Member in the membership terms and conditions at the time of sale. For example, these reasons may include (but not be limited to) unwillingness to provide personal contact information when requested.

The Member attends the event and subsequently leaves part way through to feeling unwell.

9. Membership Cards

9.1 Delivery

Your WACA Membership Card is personalised. Membership cards will be mailed out as soon as practicable after your application has been processed.

9.2 Lost or Stolen Membership Cards & eTickets

The WACA will not accept any responsibility for membership cards, e-membership cards or e-ticket/s that have been lost. Lost membership cards, e-membership cards or e-ticket/s can be reported to membership@waca.com.au. Replacement of physical membership cards will incur an administration fee of $10 per card. Members who have their membership card, e-membership card or e-ticket/s stolen or destroyed may be required to supply the WACA with a statutory declaration to that effect. Replacement cards will be mailed out or can be collected from the WACA Ground or Box Office B at Optus Stadium, however, cannot be issued on the day of a match or event.

10. Privacy and Terms of Use of WA Cricket Membership Website

10.1 Privacy

The WACA, Cricket Australia and State or Territory cricket associations, collect your personal information to communicate with you in relation to information and offers from Australian Cricket and to provide Australian Cricket’s products and services.

By providing your personal information you agree it will be disclosed to, and used by, Australian Cricket under the terms of this statement and Australian Cricket’s Privacy Policy (at waca.com.au/privacy-policy), which contains information about how you may access and seek to correct your personal information or complain about a breach of your privacy, and how Australian Cricket will deal with that complaint.

Australian Cricket may disclose your personal information to other parties, including Australian Cricket’s commercial partners and third-party service providers, who may be located (and so your personal information may be disclosed) overseas, including in India, the USA and the UK, and other countries from time to time. If you elect to receive offers and information, Australian Cricket may use and disclose your personal information to those third parties for direct marketing purposes.

You may choose not to provide the WACA with certain information, though this may affect the service that you receive and may prevent the WACA from fulfilling your membership.  As such you accept any impact or loss of rights due to that choice.

10.2 Opting out of Communications

Members may remove themselves from any Member mail and email communications at any time by following one of the following options:

  • Following the relevant unsubscribe instructions contained in any electronic communication which you receive from the WACA;
  • Writing to the WACA at PO Box 6045, East Perth WA 6892 to the attention of “Membership” requesting cancellation of any email, or mail communications;
  • Emailing the WACA at membership@waca.com.au requesting cancellation of any email, or mail communications; or
  • Contacting the WACA Membership Office on 08 9265 7279.

10.3 Website Terms of Use

At any time you enter the WACA membership website or wacricketmembership.com.au or any other website of the WACA, you agree to be bound by the terms governing use of the website that are in force at that time.

10.4 Change of Personal Details

The Member is responsible for notifying the WACA should their personal details change, including contact details or any other relevant information that could affect the Member’s membership with the WACA.

11. Technological Issues

The WACA is not responsible for any infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures, or any other causes beyond the control of the WACA, including those that cause the delay or non-delivery of emails to and from the WACA. The WACA reserves the right to disqualify any individual who tampers with the registration process and to cancel his or her membership of the WACA.

12. Amendment of the Terms and Conditions

The WACA may vary these terms and conditions at any time in its discretion.

The WACA will give notice of any amendments to these terms and conditions by:

  • Email to the email address which you notified us of on the registration page or in any subsequent communication we receive from you updating your contact details; or
  • Posting the revised terms and conditions on wacricketmembership.com.au.

Your continued registration as a Member of the WACA after such notifications above will constitute acceptance by you of any amendments to the terms and conditions.

13. General

These terms and conditions are governed by the laws of Western Australia. Each party submits to the non-exclusive jurisdiction of courts exercising jurisdiction there in connection with matters concerning these terms and conditions.

No failure to exercise or delay in exercising any right, power or remedy by the WACA under these terms and conditions operates as a waiver of that right, power or remedy by the WACA.

Any clause or provision of these terms and conditions that is prohibited or unenforceable in any jurisdiction is ineffective as to that jurisdiction solely to the extent of the prohibition or unenforceability. That does not invalidate the remaining clauses or provisions of these terms and conditions or affect the validity or enforceability of that clause or provision in any other jurisdiction.
